1. DEFINITIONS
DenyAll : refers to UBIKA, provider of secure Web application delivery solutions , headquartered in Aix en Provence, trade number 451 293 948 000 27.
Site Support DenyAll : refers to the Extranet website serving customers, prospects and partners of UBIKA via the Internet at the following URL: https://my.ubikasec.com.
User : refers to an adult, who makes use of the Services available on the portal my.ubikasec.com.
Editorial content : refers to the information accessible to Users of my.ubikasec.com, either directly online or by download.
Services : refers to access, consultation and search facilities offred by UBIKA to the Users of the website my.ubikasec.com. The services include the means to reach Editorial Content and specific services (technical support, ticket manager).
Profile : refers to the access profile attributed to a User. Editorial Content and available Services on the website my.ubikasec.com are filtered occording to the User Profile. The Profile is determined by UBIKA in accordance with the request received from the User and the conditions for access.
Settings : refers to the personal information recorded by the User when signing up for access to my.ubikasec.com and any data provided when using my.ubikasec.com Services (request for help, technical support, etc.)
Intellectual Propert Clause : refers to trademarks, domain names, copyrights, designs and models, patents, database rights and all other intellectual property made use of by UBIKA and required for its activity as an IT security vendor.
Form : refers to sign-up or information request forms that the USer can fill out for access to certain UBIKA services after reading and accepting the Terms and Conditions.
Hypertext Link : refers to the system of reference represented by items like a word, an image or a logo that enables you to go from one document to another on a website or from one website page to another, by mouseclicking the item.
2. OBJECT
The Terms of Use define the terms and conditions governing UBIKA's offer of Services to Users of my.ubikasec.com. The use of any of the Services offered by UBIKA is subject to the acceptance and respect of the Terms of Use.
3. ACCEPTANCE OF THE TERMS OF USE
The User declares that he/she has read the Terms of Use applicable at the time of subscription to the Services offered by UBIKA and confirms full and unconditional acceptance of those Terms of Use.
UBIKA reserves the right to make full or partial changes to the Terms of Use at any time. It is therefore imperative for the User to regularly update his/her knowledge of the rules which are permanently available for consultation on the UBIKA website, in the Legal Notices page. Once the Services are used following the application of changes to the Terms of Use, the User's acceptance of the new termes and conditions is taken for granted.
4. INTELLECTUAL PROPERTY COPYRIGHT
The User acknowledges that UBIKA is the sole holder of Intellectual Property Copyright pertaining to the my.ubikasec.com website, its Editorial Content and Services.
None of the articles in these Terms of Use shall be interpreted as granting licence to the User on the Copyrights held by UBIKA.
UBIKA allows its Editorial Content to be viewed by the User in a personal and private capacity only. No reproductions or public circulation and viewing will be tolerated.
Any unauthorised representation, reproduction or extraction of UBIKA's Editorial Content, website and all copyright material is completely prohibited and subject to punishment by the law. The offending party will be pursued on civil and criminal grounds in accordance with the articles L. 335.2 et L. 343.1 of the Copyright law applicable in France.
5. RESPONSIBILITY
UBIKA takes the best care possible in the creation and publication of Editorial Content and in the provision on Services.
Nevertheless UBIKA cannot guarantee the reliability of its Editorial Content or Services. Consequently, UBIKA may not be held responsible for damages a User incurs when making use of the Services or the information appearing in the Editorial Content for any purpose whatsoever.
The website my.ubikasec.com contains Hypertext links to third-party websites. UBIKA cannot exercise any form of control over these websites and cannot be held resposible for their content. The existence of these links does not imply approval on the part of UBIKA as to the content appearing on the websites. References to these websites on UBIKA's website do not commit the responsibility of UBIKA in any way. UBIKA therfore does not guarantee :

The User agrees to exercise sound judgement when making use of the Editorial Content and Services, to make the necessary checks involving his or her responsibility and to take responsibility for the risks involved.
The User acknowledges the following: :
- " He or she uses the Services at his or her own risk, especially for the downloading of data, files and software that can be harmful to the User's PC. UBIKA cannot be held responsible for any data loss, viruses, bugs or other problems affecting his or her PC ;
- " UBIKA does not guarantee that the Services Provided respond to the User's expectations;
- " UBIKA does not guarantee the quality and or lawfulness of content not created by UBIKA, especially for content and opinions expressed by the USer or circulated on external websites that can be reached by a Hypertext Link ;
- " UBIKA cannot be held responsible for any data circulated by the User in violation of third party privacy policies or copyrights ;
- " UBIKA cannot be held responsible for problems of technical origin and especially the downtime or any other dysfunction of its website ;
- " UBIKA cannot be held responsible for direct or indirect damages such as financial loss, shortfalls or incidents of any kind resulting from the use or impossibility to use the Services Provided.
Moreover, the User guarantees not to undertake any legal action against UBIKA for any reason, including the context of data seizure and any individual who may claim to be affected by the publishing of the said data on the website. The User declares that UBIKA will not be held responsible for any ensuing legal or other fees.
6. ACCEPTANCE OF INTERNET RISKS
UBIKA takes all the precautions possible to ensure the security of the website my.ubikasec.com and its User connections but remains dependent on the public Internet network; the my.ubikasec.com User has to bear in mind the associated specifications and limits, be aware of best practice deontology and acknowledge:

7. ACCESS TO SERVICES
UBIKA will try as far as possible to maintain accessibility to my.ubikasec.com but may occasionally have to shut down for maintenance. UBIKA can in no way be held reponsible for the consequences to the User of the shutdowns.

8. CONDITIONS FOR ACCESS TO SERVICES
8.1 CONDITIONS FOR ACCESS TO SERVICES
The website my.ubikasec.com is an Extranet for UBIKA prospects, customers, resellers and partners. Access to the site is complimentary and is achieved by an initial request that has to be accepted by UBIKA. Each request is personal and login information must at no time be communicated to any other individual, including colleagues within a company.
8.2 SIGNING-UP AND REQUEST FOR ACCESS
For access to the Editorial Content and Services of my.ubikasec.com, the User has to respect a registration process wherby he or she has to provide a personal description by answering different questions. The User is obliged to provide accurate and complete details and to make any changes whenever these should be necessary.
8.3 ACCEPTANCE OF REQUESTS AND USER PROFILES
Account requests are processed by UBIKA as soon as possible. The checks made by UBIKA can sometimes entail requests for more information. After the checks are made UBIKA either grants or refuses my.ubikasec.com accounts and informs the requesting party of the decision by e-mail.
For accepted accounts UBIKA provides login details to the new User and assigns a Profile that defines the level of access to Editorial Content and Services.
Full access profiles to Editorial Content and Services are reserved for customers and certified resellers of UBIKA. Access profiles require a User to provide a professional e-mail address based on a domain belonging to the company attached to the account.
The User agrees to use and safekeep his or her access codes to my.ubikasec.com with the utmost confidentiality. If the access codes are stolen the User agrees to notify UBIKA as quickly as possible of the theft.
8.4 ACCEPTANCE OF THE TERMS OF USE
During the signing-up process, the User declares that he or she has read and accepted the Terms of Use in effect at the time of subsccription to the Services of my.ubikasec.com. The User clicks the checkbox for "I accept the Terms of Use of the Extranet my.ubikasec.com".
The message recieved by the User containg login information also informs the User that use of the login details is equivalent to the confirmation of acceptance of the Terms of Use applying to my.ubikasec.com.
By clicking on the icon attached to "I accepte the Terms of Use" and confirming via the use of login details, it is considered that the User has given irrevocable agreement.
8.5 SUSPENSION OR REVOCATION OF ACCESS
Access to my.ubikasec.com is granted for professionals who work with UBIKA. The User therfore formally agrees to inform UBIKA immediately of any change in activity, which can lead to modifications or cancellation of the User account.
Any violation of the Terms of Use will lead to immediate revocation of the rights of access to my.ubikasec.com. UBIKA furthermore reservces the right to suspend or revoke the access of any User whose use of the site my.ubikasec.com is considered by UBIKA as contrary to the principles governong the website.
9. PERSONAL DETAILS - PRIVACY POLICY
UBIKA gathers the information provided by the Users via forms that appear on the Web site my.ubikasec.com or sent directly to the Users.
In respect of the fact that personal information gathering and processing is required to comply with fundamental privacy rights, UBIKA strictly adheres to the legal terms set down by the modified Law of 6 January 1978 (France, articles n°78-17 concerning Information Technology, Data and Privacy.
The User may consult (article 39 of the modified Law 78-17), change and delete (article 40 of the same) any of his or her personal information.
The User also has the right to refuse the use and processing of his or her personal data (article 38 of the modified Law 78-17).
The User may choose to assert his or her rights at any time by either directly modifying the personal data that appears on the website my.ubikasec.com within the section entitled My Account, or by sending an e-mail to remove@ubikasec.com. The User will be able to correct, complete, clarify, update or delete any personal information that is inaccurate , incomplete or expired. A maximum of 15 days is required before the User's request is processed.
UBIKA will take the utmost care to protect Personal Details and precent them from being tampered with, damaged or sent tto third parties without permission.
10. APPLICABLE LAW
The present Terms of Use are governed by French Law. Litigation over the interpretation and execution of these conditions will fall under the jurisdiction of the courts of Aix-en-Provence.
Privacy Policy
In compliance with the Law n°78 - 17 of 6 Januray 1978 concerning information technology, databases and privacy, modified by Law n°2004-801 of 6 August 2004, the procesing of private data entered to the website my.ubikasec.com has been fully declaredand recorded under the number 1404776, with the Commission Nationale de l'Informatique et des Libertés (National Information and Privacy Commission).
my.ubikasec.com website Users are required to respect the terms laid down by the Law on information technology, database files and privacy. Any infringement will entail legal repercussions. Due to the nominative nature of the information that is accessible to Users, the latter are required to refrain from gathering and using the data in any way that may affect the privacy or reputation of any individual.

Your data is processed by UBIKA marketing and technical departments, and is not forwarded externally except to UBIKA partners who are directly involved in providing the services on offer especially in the case of support and maintenance missions.
You may obtain the list of partners receiving your data by contacting UBIKA. You have the right to refuse that your details be communicated to those partners. In that case you acknowledge that UBIKA cannot provide the support required and you accept the consequences. In compliance with article 34 of the IT Law « Informatique et Libertés » n°78-17 of 6 January 1978, you have the right to consult, modify, correct and delete your personal data. You can exercise this right at any time by either directly modifying the personal data that appears on the website my.ubikasec.com within the section entitled My Account, or by sending an e-mail to: mailto:support@denyall.com or by sending a letter to UBIKA headquarters in Aix en Provence. A maximum periosn of 15 days is required for your request to be processed
